Federal FLSA Overtime Rules

Under the Fair Labor Standards Act (FLSA), non-exempt employees must receive overtime pay of at least 1.5× their regular rate for all hours worked beyond 40 in a workweek. The FLSA does not require overtime for work on weekends, holidays, or hours in a single day unless weekly total exceeds 40.

California Overtime Rules

California law is stricter than federal law. Employees earn 1.5× pay for hours worked over 8 in a day OR over 40 in a week. Double time (2×) applies to hours over 12 in a single day and all hours on the 7th consecutive day of work in a week.
